Terms of Service

SEC.01 // ACCEPTANCE

By accessing or using FaceTell ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. FaceTell is operated by an individual creator at FaceTell.app.

SEC.02 // THE SERVICE

FaceTell observes patterns in the visible state of a photo you submit — sleep, expression, presentation, transient signals — and generates an observational report ("your report"). The Service is provided for self-reflection and entertainment purposes only.

What FaceTell is not. FaceTell is not a personality test, psychological assessment, medical service, dermatological service, intelligence measurement, criminality predictor, ethnicity classifier, or claim about innate traits. Nothing in your report constitutes medical, psychological, dermatological, employment, or any other professional advice. Do not rely on your report for health, clinical, hiring, or relational decisions.

The archetype name and observational readings describe patterns the system recognized in this photo at this moment. They are not verdicts about who you are, what you can become, or what you have done. AI-generated analysis is probabilistic and may be inaccurate, incomplete, or inconsistent across sessions or photos of the same person. Results are not guaranteed to be correct or representative of any objective condition.

SEC.03 // ELIGIBILITY

You must be at least 18 years of age to use this Service. If you are between 13 and 17 years of age, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. The Service is not directed at children under 13.

You represent that your use of the Service complies with all applicable laws and regulations in your jurisdiction.

SEC.04 // PAYMENTS

Certain features of the Service require a one-time payment of $4.99 USD to unlock a full report. All payments are processed by Polar Software, Inc. (“Polar”), who acts as Merchant of Record. By making a purchase, you also agree to Polar's terms of service and privacy policy.

Polar is responsible for collecting payment, issuing receipts, calculating and remitting applicable taxes, and processing refund requests. FaceTell never receives or stores your payment card details.

Prices are listed in USD. Polar converts and charges in your local currency where applicable. All applicable taxes are calculated and included by Polar at checkout.

SEC.05 // YOUR CONTENT & FACE DATA

You retain all rights to the photos you submit. By submitting a photo, you grant FaceTell a limited, temporary licence to process the image using AI services solely for the purpose of generating your report.

Your photo is stored in a private, access-controlled storage bucket and is only accessible via a time-limited signed URL. We do not sell, share, or use your photo or likeness for advertising, model training, or any purpose beyond delivering your report.

Reports and any associated images (photo, halftone, archetype portrait) are retained for 30 days from creation, then automatically deleted. You may request earlier deletion by emailing hello@facetell.app with your report reference number.

SEC.06 // INTELLECTUAL PROPERTY

The FaceTell name, design system, analysis methodology, and generated report format are proprietary to FaceTell. The AI-generated text in your report is provided to you for personal use. You may share your report card on social media for non-commercial purposes.

You may not resell, redistribute, or use the Service's output for commercial purposes without written permission.

SEC.07 // DISCLAIMERS

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. FACETELL MAKES NO WARRANTIES REGARDING ACCURACY, COMPLETENESS, OR FITNESS FOR ANY PARTICULAR PURPOSE.

We do not guarantee that the Service will be available at all times, error-free, or free of harmful components. We reserve the right to modify, suspend, or discontinue the Service at any time.

SEC.08 // LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FACETELL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TRANSACTION GIVING RISE TO THE CLAIM.

SEC.09 // CHANGES TO TERMS

We may update these Terms from time to time. The effective date at the top of this page will reflect the date of the most recent revision. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

SEC.10 // GOVERNING LAW

These Terms shall be governed by and construed in accordance with applicable law. Nothing in these Terms limits any statutory rights you may have under applicable consumer protection legislation in your jurisdiction, including EU/UK consumer rights law.
